車禍肇責分析 - 機車

如上圖「紅圈地方」
當時本人騎乘機車直行基河路往中山方向,車速大約35
對方於對面待轉區行駛士林方向
途中有一輛公車擋在待轉區前等行人，對方可能不耐久候，直接於公車的尾巴切出。
我方行駛至公車尾巴突見對方竄出，直接煞車鎖死，車倒地面，我方車損乘客受傷，對方無受傷無車損。
日前收到初判表，對方是「涉嫌未注意車前狀況，並隨時採取必要之安全措施」。我方是「涉嫌駕駛失控」。
請問這樣責任的比例大約多少，在網路上搜尋駕駛失控的例子好像很少，謝謝大家。
