穿越馬路被撞 騎士沒責她有責

基隆市洪姓男子騎機車行經復興路時，閃避不及，撞上橫越馬路的林姓婦人，雙方互控傷
害。但檢察官認為，林婦違規，才是車禍主因，依法起訴，聲請簡判，至於洪男，沒肇事
責任，不起訴處分。
檢警調查，21歲的洪姓男子去年11月8日晚間8點多騎機車載劉姓友人，行經復興路82之2
號前，當時71歲的林姓婦人想要到對面路邊的清潔車丟垃圾，從他前方約6公尺處竄出，
橫越馬路。
洪男發現林婦出現在車道後，雖緊急煞車，但仍撞上，人車倒地，雙方分別受傷，由於事
後未能和解，互控過失傷害。
洪、劉都指出，林婦穿越兩輛路邊停車，跨步橫越馬路時，只朝右側看對向是否有來車，
並沒有朝左邊看，才會沒有注意到洪男的機車已經駛來，導致車禍發生。
檢察官認為，事故路段的復興路雙向車道間畫有雙黃線，行人不得穿越，林婦違規橫越馬
路，並導致洪男受傷，有過失傷害罪嫌。
另依公路總局基宜區車輛行車事故鑑定會提出的分析意見書指出，肇事路段速限50公里
，安全煞停距離是24.5公尺，林婦在洪男機車前方約6公尺處衝進車道，實在煞車不及，
難要他負擔肇事責任，不予起訴。
